Creditor representation in insolvency proceedings

Registering claims and protecting creditors’ rights under German insolvency law.

Registration and verification

Following the opening of insolvency proceedings, insolvency claims generally need to be registered with the insolvency administrator (section 174 InsO). The amount and legal basis must be documented.

Participation and security rights

We examine the claims table, objections, communications from the administrator, creditors’ meetings and, where applicable, security or separation rights.

Documents and approach

Contracts, invoices, proof of payment and insolvency notices are reviewed to determine the appropriate steps.
